Article 12 – Conditions of use

The user of the service acknowledges that the validity of the offers proposed by the partners, directly or through their representatives, is subject to the accuracy of the answers provided and that incorrect answers may lead to the contract being rendered null and void. The user therefore undertakes to answer all questions loyally and honestly. The user of the service acknowledges and accepts that the very nature of the insurance and credit business may lead the partners in this field who work with Comparer-Changer to be unable to propose offers for certain profiles, although Comparer-Changer makes its best efforts to be able to propose offers to the widest possible number of profiles. The user of the service is responsible for and discharges Comparer-Changer of any liability in the event that, after having entered his/her profile, Comparer-Changer is unable to present him/her with an offer. The offers presented by Comparer-Changer are subject to a certain number of subscription conditions. The user of the service undertakes to read the general terms and conditions and the special terms and conditions before definitively signing the contract and to check that his or her situation is consistent with the contract he or she is signing and the data recorded by the partner, and releases Comparer-Changer from any liability in this respect. In order to provide you with offers that correspond to your profile, Comparer-Changer may collect personal nominative data. Users of the service acknowledge that Comparer-Changer provides them with factual information on offers, that this information is necessarily limited and incomplete by the very nature of the technology used. Users acknowledge and accept the need to read all the general and special terms and conditions of their contract before subscribing in order to have an exhaustive view of the nature of the contract they are subscribing to, and release Comparer-Changer from any liability in this respect. Article 18: Usage data and management of cookies

As part of our Internet pages, we use what are known as cookies. These are small text files placed on your hard drive by the website visited, enabling it to record and store certain information about your computer and also about you.

They are essential to the operation of the Internet, as they enable two computers to communicate properly. The information recovered is also used to run applications that you use on the website.

For further information, please consult ourCookie Management Charter.

You can visit our web pages without providing any personal data. However, when you visit our pages, certain technical data will be generated, known as usage data. In addition, we may install one or more cookies, about which we would also like to inform you in the following.

18.1 – What are cookies?

We use cookies on our Internet pages. These are small files that are stored on your hard disk and in which certain information is stored so that a server can read it again. These cookies can be either session cookies, which are automatically deleted as soon as you close your browser, or cookies with a longer, predefined runtime. When you visit one of our websites, our partner Sirdata creates cookies that enable tailored offers to be communicated – for example, by displaying ‘banners’ – also on other websites on which CMP SIRDATA technology is implemented.

18.2 – Cookies used on Comparer Changer

Google Analytics (audience measurement). The cookie installed by Google Analytics makes it possible to measure the audience anonymously. The IP address used to geolocate the Internet user is no more precise than the city level. In practice, the last two bytes of the IP address are deleted.

The information stored in cookies may include your identifier (your visit when you registered), the date and time of your visit, all your behaviour on our competition pages, the cookie number and the URL of the website from which you accessed our offer pages.

The use of certain cookies enables us to guarantee the functionality of our websites and to continually improve their performance. In addition, cookies help us and our partner to recognise you and thus to tailor our offers – also on other pages on which our partner is active – optimally to your individual needs and to display the information that is most relevant to you. This technology enables us to transmit the personal data you have previously communicated when registering for one of our competitions, polls or surveys and which you have given us permission to use for commercial purposes in a direct and practical way to our sponsors whose services interest you. Finally, cookies are used to record the statistical frequency of visits to the various pages of our site and general browsing.

18.3 – How do I configure or refuse cookies?

18.3.1.1 Agreement on cookies

The recording of a cookie in a device is essentially subject to the will of the user of the Device, which the user may express and modify at any time and free of charge through the choices offered to them by their browser software. If you have accepted the storage of cookies on your Device in your browser software, the cookies embedded in the pages and content that you have consulted may be stored temporarily in a dedicated space on your Device. They will only be readable there by the sender.

18.3.1.2 Refusing cookies

If you refuse to accept cookies on your device, or if you delete the cookies stored on your device, you will no longer be able to benefit from a certain number of functions which are nevertheless necessary to make full use of our site. In accordance with article 27 of the French Data Protection Act of 6 January 1978, this website was declared to the CNIL on 1 August 2020. Comparer Changer informs its users that personal data collected on its site is subject to automated processing.

This includes personal data collected during :

  • connecting to the Comparer Changer site via cookies

18.4 – Push Notifications

You can register to receive push notifications. To do this, we use the ‘CleverPush’ service operated by CleverPush GmbH, Nagelsweg 22, 20097 Hamburg (‘CleverPush’).

You will receive regular information about Products or services.

To subscribe to push notifications, you will need to confirm your browser’s or terminal’s request to receive notifications. This process is documented and saved by CleverPush. To this end, the time of registration and a push token or device identifier are recorded. This data is used on the one hand to send you push notifications and on the other hand as proof of your registration. The legal basis for this processing is your consent and therefore Article 6, par. 1 letter a of the RGPD.

CleverPush also evaluates the statistics of our push notifications. CleverPush can thus recognise if and when our push notifications have been displayed and when a user has clicked on them. This enables us to determine which push notifications are of interest to recipients in order to tailor future messages to the presumed interests of all recipients and thereby increase interest in our offer. In addition to the push token or device ID, we also record the central theme of the application on which push notifications have been activated (e.g. business, sport, etc.). We also use this information to send the relevant subscribers push notifications in their presumed interests. The legal basis for the processing is Article 6(1) letter F of the GDPR. A push token or device identifier is assigned to a specific person only if we are legally required to do so, to defend against claims against us if this is necessary as evidence, and to prosecute a possible breach of the law.

You may at any time revoke your consent to the storage and use of your personal data to receive our push notifications with effect for the future. In addition, you may at any time object to the use of your personal data as described above in accordance with Article 6, paragraph 1 letter f. To this end, please revoke your consent. You can revoke your consent in the appropriate setting for receiving push notifications in your device or browser settings.

Your data will be deleted as soon as it is no longer required for the purpose for which it was collected. Your data will therefore be kept for as long as your subscription to our push notifications is active.

The release process is explained in detail under the following link: cleverpush FAQ.

In order to speed up the retrieval of content (e.g. images) and to defend against attacks, CleverPush uses cloudflare.com, a Cloudflare, Inc. offering, to process orders on the basis of standard contractual clauses.

On Cloudflare servers, CleverPush does not store any data containing personal data, but only general content such as text or images. When retrieving this content, the device you are using establishes a connection to Cloudflare, which involves processing the IP address of the terminal you are using.
